A regular meeting of the Board of Education of the Enlarged City School District of Middletown, New York was held Thursday, December 4, 2008, at the Board of Education Office, 223 Wisner Avenue, Board President Nicholas Mauro, presiding.
Present: Mr. Geiger, Mrs. Isseks, Mrs. Knapp, Mrs. Martinez, Dr. Mauro,

Dr. Mauro called the meeting to order at 7:05 p.m. Mrs. Knapp made a motion, seconded by Mrs. Martinez, to have an executive session to discuss matters leading to the appointment or employment of a particular person.
Public session resumed at 7:40 p.m.
Mr. Paul led the pledge to the flag.
Dr. Mauro stated that the following items that were originally in the Board’s packets were removed from the agenda: Action Item #’s 4 and 5 were removed previously before the meeting and Item #14 on the Financial Memorandum was removed previously before the meeting.
Mr. Paul made a motion, seconded by Mrs. Martinez, to approve the agenda with the following amendments: Move Approval of Personnel Memorandum #14 to after the Approval of Agenda (no vote taken).
Mr. Perrino requested to add under Action Items: Approval of RSA as Architect of Record for Proposed New Project. A discussion pursued.
Mr. Perrino made a motion, seconded by Mrs. Martinez, to approve adding to the agenda, Action Item #4: Approval of RSA as Architect of Record for Proposed New Project and to approve the agenda as amended above. A discussion pursued.

OPPORTUNITY TO ADDRESS THE BOARD
- Edward Godwin – Presented to the Board information concerning change orders in the District’s construction project that he compiled from NYS Education Department’s website (see attached).
- Heather Friedman – Acknowledged the District and Special Services for contributing to her daughter’s successes and making a difference in her life.
- Ralph Savarese – Expressed concerns as a taxpayer regarding the new school construction project. Asked if economic studies were conducted and if the District has the funding for this construction project. Mrs. McKean advised that the latest studies conducted are available on the District’s website as well as the funding information.
- Ashaki Brown – Addressed concerns regarding an incident with her son at Middletown High School. Mr. DelMoro advised that he will request the Hearing Officer have a conversation with the Superintendent when he returns on Monday.
- John Gennarelli – Discussed Chorley being torn down, letters of credibility on his behalf, Guardian Angels, previous board meeting discussions, his concerns with the kids being the most important issue.
WRITTEN CORRESPONDENCE
Ms. Towle read a letter from Biggerstaff Law Firm concerning the Board of Education considering whether to join the current educational funding lawsuit against the State (copy available upon request).
RECOGNITIONS/ANNOUNCEMENTS/COMMUNITY REPORT
Mr. Perrino reported the following events:
- Paul Halpern agreed to donate 2 air rifles when the air rifle team is back at the High School
- Acknowledged volunteers who worked the Thanksgiving day brunch at the High School – 300 dinners were served
- Winter track program
- Articles on Tech and Literacy programs
- Breakfast for honor roll students
- NJROTC in Elk’s bulletin for participating in pancake breakfast
- Monhagen Musical Book Fair
The High School Student Council and Senior Student Body presented a $200 check, and the High School Choirs presented a $392 check to Mr. Alan Gonzalez, Executive High School Principal, to help defray the costs for his trip to Athens, Greece, where he was recognized for the International Administrator’s Award.
Mr. Gonzalez discussed a private donation of vehicle driving simulators for students learning to drive. He advised that the simulators would be rotated throughout the county for the students to use.
Mrs. Knapp stated that Gregory Bennett has 2 students from High School who made the state chorus in Rochester. Also, students from the High School attended an event for the NYS Music Association.
The Board discussed participating in the Small City Schools lawsuit and Dr. Mauro advised that this would put pressure on the State to adequately fund our schools. Ms. Perkins advised that the cost to participate would be $5,000 per year for each district. Mr. Perrino asked if we asked our attorney and our administrator’s recommendation on this. Dr. Mauro replied that we have not received a specific recommendation. Mrs. McKean advised that we have not budgeted for this expense for this coming year.
Mrs. Isseks made a motion, seconded by Mr. Paul, to participate in the Small City Schools litigation.

SUPERINTENDENT’S REPORT
Mr. Richard DelMoro and Mr. Gordon Dean introduced a program called Rachel’s Challenge, which is designed to inspire, instruct and enable students to bring positive change to the school atmosphere by empowering students to create a caring and compassionate culture in both school and community. The funding source for this program comes through the Safe School/Healthy Students Grant.
Mrs. Martinez made a motion, seconded by Mrs. Knapp, to approve Special Services Memorandum #9. A discussion pursued regarding the appointment of Mr. Gennarelli to the Committee on Preschool Special Education. Mrs. Selena Fischer stated the qualifications for serving on this committee and advised that Mr. Gennarelli met the criteria.

Ms. Tobiassen made a motion, seconded by Mrs. Knapp, to table the motion to establish a code of conduct to attend meetings with recourse.

Ms. Tobiassen made a motion, seconded by Mrs. Knapp, to approve Financial Memorandum #11 (no vote was taken). A discussion pursued regarding Financial Memorandum #11, Item #5 – Approval of Contract for Professional Services with Beverly Flaten. Ms. Perkins requested that Item #5 be separated into a line item and be voted on separately. Mrs. Knapp stated that if Item #5 is voted on, she would like to see the evaluations.
Mrs. Knapp made a motion, seconded by Mr. Perrino, to approve Financial Memorandum #11, Line Item #5 – Approval of Contract for Professional Services with Beverly Flaten (6 + 1 Traits Training – SINI and Title IIA Grant).

At 10:25 p.m., Dr. Mauro called for a recess and a short mini-retreat to discuss Board related matters.

- Jimmy DeGraw – Commented on the appointment this evening to the Committee on Preschool Special Education.
ROUNDTABLE
Mr. Perrino questioned what our attorney’s retainer costs have been this year. Dr. Mauro said that he had requested a breakdown from our attorney and will supply it to the Board when he receives it.
Mrs. Knapp stated that her concerns are, if we use up our retainer, what are we going to do for the rest of the year. Mrs. Knapp announced that Mr. Bennett’s choral group will be singing with Tim Janis on December 20, 2008, and will be going to Carnegie Hall to sing with him.
Ms. Tobiassen made a motion, seconded by Mr. Geiger, stating that she called for a motion during the October meeting and called for Ms. Perkins to step down as Vice-President, stating that this position can be left open or have a senior member fill the position, and clarifying that this motion is for her to step down as Vice-President, not for removal from the Board. Ms. Tobiassen requested that the Board vote on her original motion at this time. A discussion pursued. Dr. Mauro and Ms. Perkins advised that a legal opinion was received from our attorney, where it was stated that there has to be specific charges to substantiate that action and must have evidence of misconduct. No vote was taken.
Dr. Mauro advised the public that the referendum vote will be on December 18, 2008. Voter Registration Day will be on December 11, 2008,

There being no further business, at 11:30 p.m., Mr. Perrino made a motion, seconded by Mrs. Knapp, to adjourn the meeting. Motion was unanimously approved.
