A regular meeting of the Board of Education of the Enlarged City School District of Middletown, New York was held Thursday, September 6, 2007, at the Board of Education Office, 223 Wisner Avenue, Board President Rose Tobiassen, presiding.
Present: Mr. Estrada (arrived at 8:25 p.m.), Mrs. Knapp, Dr. Mauro, Mr. Paul (stepped out 8:35-8:45 p.m.), Ms. Perkins (stepped out 10:24-10:27 p.m.), Mr. Perrino, Mr. Geiger (stepped out 9:45-9:48 p.m./9:57-10:00 p.m.), Ms. Tobiassen – 8.

Ms. Tobiassen called the meeting to order at 7:30 p.m
Mrs. Knapp led the pledge to the flag.
Ms. Tobiassen read a prepared statement concerning a letter that was delivered to the Middletown Common Council regarding a possible conflict with her membership on the City’s Ethic Committee. She advised that the letter was referred to
the school district counsel for legal opinion.
Mr. Perrino made a motion, seconded by Dr. Mauro, to approve the minutes of June 7, 2007.

Ms. Tobiassen presented the Title I Parent Involvement policy as a second reading and stated that a third reading and approval will be done at the October 4, 2007 meeting.
Ms. Perkins made a motion, seconded by Mr. Perrino, to approve Final Payment to BMI – Theater Contract and to approve Final Payment to DeLorenzo – Twin Towers Middle School Stairs.

PRESENTATIONS:
Sheila Esposito presented the Annual Professional Performance Review (APPR)- (see attached).

OPPORTUNITY TO ADDRESS THE BOARD:
- Alan Gonzalez, Executive Principal at Middletown High School – discussed opening day of school at the High School.
- Kathy Bellars – discussed issues concerning start of school year at Middletown High School.
- Fred Isseks – presented questions to the Board concerning the opening day of school at Middletown High School.
- Doug Allen – addressed student scheduling concerns.
- John Gennarelli – discussed responsibility of student scheduling issues.
ROUNDTABLE:
The Board discussed student scheduling issues and Crosspointe.
Mr. Paul addressed lowering the term that a Board member serves from 5 years to 3 years. Ms. Tobiassen advised Mr. Paul to submit a written resolution to her and it will be considered for placement on the agenda.
Mr. Estrada made a motion, seconded by Mr. Paul, to amend the agenda to change further Roundtable discussion to after the second Opportunity to Address the Board.

- Doug Allen – commended the district on a superb job on supervision and teaching and readdressed his student scheduling concerns.

The Board discussed their opinions on board members visiting school buildings within the district.
At 11:15 p.m. Ms. Perkins made a motion, seconded by Mrs. Knapp, to have an executive session to discuss proposed, pending or current litigation.

Dr. Mauro made a motion, seconded by Mr. Perrino, approve a resolution to establish a District Liability Reserve Fund as follows:
WHEREAS, the Board of Education is on notice of claims from various parties related to the 2003 High School Construction Project, and WHEREAS, the Board of Education is on notice of potential liabilities relating to various ongoing litigation, HEREBY, BE IT RESOLVED, that the Board of Education establish a District Liability Reserve Fund to protect the district from current or future unsettled claims or suits. AND ALSO, BE RESOLVED, that the Board of Education fund the District Liability Reserve by appropriating $1,500,000 of Fund Balance.
