A regular meeting of the Board of Education of the Enlarged City School District of Middletown, New York was held Thursday, March 6, 2008, at the Board of Education Office, 223 Wisner Avenue, Board President Rose Tobiassen, presiding.

Ms. Tobiassen called the meeting to order at 6:30 p.m. Mr. Paul made a motion, seconded by Mr. Perrino, to have an executive session to discuss matters regarding proposed, pending or current litigation. Motion was unanimously approved.
Public session resumed at 8:00 p.m.
Mr. Perrino led the pledge to the flag.
Mr. Paul made a motion, seconded by Mr. Geiger, to approve the agenda with the following amendments:

Ms. Tobiassen read a letter from Orange-Ulster BOCES announcing that terms of two members of the Orange-Ulster Cooperative Board expire June 30, 2008, and that candidates interested in these seats must be nominated by March 18, 2008. Ms. Tobiassen went on to read letters from Carl Onken and Mary Luciana who are seeking election to BOCES board seats.
Ms. Tobissen announced that the OCSBA Prospective School Board Members workshop will be held April 5, 2008, 9 a.m. – Noon at Orange/Ulster BOCES in Goshen.
Mr. Geiger announced the following qualifications for Middletown Board of Education membership: (see attached (PDF))
- Over 18 years of age as of the date of vote
- Qualified voter (US citizen, who has resided within the district for at least 30 days prior to election, and who is not a convicted felon currently serving jail time)
- Able to read and write
- Resident of the district for one year
- Cannot be employed by the District
- Cannot live in the same household with a family member who is also a member of the board
- May not simultaneously hold another, incompatible public office
- Must not have been removed from a school district office within one (1) year preceding the date of appointment or election to the Board

Dr. Eastwood recognized attendance accomplishments at Middletown School, stating that attendance rates have improved.
OPPORTUNITY TO ADDRESS THE BOARD
- Luke Stover – Discussed survey that was created for Middletown High School by the Student Action League.
- John Gennarelli – Had the following concerns:
Are school improvement teams actually working in our schools? Dr. McDonough said that we have a number of school improvement teams and restructuring teams in place and they meet monthly.
Asked what is the average cost to teach a student in the Middletown School District, including the cost to educate special education students? Mrs. McKean advised that there are many different factors in determining per pupil costs. Mrs. McKean can provide to anyone interested the “cost per pupil” study provided by Mid Hudson School Study Council.
Requested more programming on Channel 20.
Questioned the demographic study that was conducted three years ago by BOCES. Dr. Eastwood stated that we did not hire BOCES to do our growth study. The District hired our own demographer to determine growth.
Questioned the increased cost for the School Safety Officers. Mrs. McKean answered that we have SRO’s from City of Middletown and have discussed an inter-municipal agreement with the Mayor. We have one SRO from Town of Wallkill in which we have an inter-municipal agreement with and which will be extended for 08-09. Mrs. McKean has addressed billing concerns with the city treasurer and will advise once she hears more on it.
Requested information on who to contact when Rules and Regulations are in question. Dr. Eastwood responded to contact State Ed.
What is average time that teachers spend in the classroom?
It was noted that Superintendent Approved Budget Transfer should be #9 on the agenda as it was inaccurately listed at #10 on the agenda.
A third reading of Regular Board Meetings policy and Visitors to the School policy was conducted and it was agreed that no further changes need to be made to either of the policies.

RESOLVED, that the Board of Education increase Donoghue, Thomas, Auslander & Drohan, LLP hourly rate to $200 per hour for 2008-09.
RESOLVED, that the Board of Education increase Donoghue, Thomas, Auslander & Drohan, LLP retainer amount to $64,000 to cover the amount of extra time, which is expected to reach approximately 400 hours for 2008-2009.

Mr. Crescenzo made a motion, seconded by Dr. Mauro, to approve Contract for Professional Services with Nautilus Consulting, LLC as follows:
RESOLVED, that the Board of Education approve the contract for professional services with Nautilus Consulting, LLC as proposed in the attached contract for the purpose of providing consulting services in regard to litigation with Morris Park Contracting Corporation.

BOARD MEMBER REPORTS
Mrs. Knapp explained that the Restructuring Committee has been in place for 3 years and she is the representative for the High School. They have set forth projects such as late to school policy and attendance policy in efforts to enforce them. Their presentation has been sent to the State and in April the Committee will do a presentation to the Board.
Mr. Paul commended NJROTC’s annual pass-in-review ceremony and potluck dinner.
Dr. Mauro suggested developing a policy for clarification on Board hearings. He also discussed modifying the bomb threat policy concerning who clears the building. Dr. Eastwood advised that it can be done thru Regulation rather than Policy.
ROUNDTABLE:
Mr. Perrino addressed the Contract for Excellence letter that Dr. Eastwood sent to New York State Senate. Dr. Eastwood explained that it shows an update of the impact from last year’s legislation and shows the current fiscal impact (see attachment). Dr. Eastwood explained that there is a misnomer that schools who are identified as in need of improvement, received extra money (more than other districts). The answer to that is, no we did not, we all received state aid increases last year. Those schools that were identified have a restriction on how they can use that money. Districts that are not identified have the freedom to use state aid from last year and this year the way they so desire, no restrictions. Contract schools (schools/districts like ours that are identified), have to develop a Contract for Excellence which is an agreement between the District and the New York State Education Department on how we are going to spend the additional state aid. That is a requirement that only identified districts are obliged to. In the 2007-2008 school year budget, we had to increase taxes by an average of 3.3%. If we had the freedom to use the new state aid as every other district that is not identified, we would have had a 0% increase. Contract for Excellence causes us to engage in certain programs that we already started in previous years. The State is not allowing recognition of those programs because we started before their deadline last year under the new Contract for Excellence. Last year the Governor and Legislature promised us a certain amount of money in each of the next 4-5 years and have already started to renege on that, reducing our state aid by $1.8 million less than what they told us last year that we would be getting because we were fiscally responsible and spent less per pupil than the average district in this state. They are giving it to the districts that spend more than the state average. Dr. Eastwood suggested that the people who live in our school district start contacting our Legislature and Governor to address this situation. The Contract for Excellence fiscal impact information will be posted on our website (see attached).
Mr. Perrino acknowledged the recent Renaissance breakfast for honor roll students.
Mrs. Knapp reminded the public that the Volunteer Tax Assistance Program that is being offered at the High School until March 26. Also announced was the John R. Brigham Music Scholarship Concert at the High School on March 7.
Mr. Crescenzo mentioned a former student, Aaron Tviet, who was cast for Catch Me If You Can production on Broadway.
Dr. Mauro requested to have at least one opportunity to address the board at every board meeting. Ms. Tobiassen said that she would take it under consideration. Dr. Mauro requested diversifying the offerings on Channel 20. Dr. Eastwood advised that we rotate the content at different times and we can take another look at it. Dr. Mauro suggested that our presentations be pre-recorded prior to the meetings.
Mr. Estrada announced the Harlem Wizards will play on March 9 at the High School. Challenge Night will be held on March 14. A letter was read from SUNY-ORANGE announcing the Sojourner Truth Awards Program being held on March 7.
Mr. Geiger announced the Kiwanis Key Club breakfast to be held on March 8 at the High School and on March 14, the Drama Club is hosting theatrical performances at the High School’s Coffee House.
Mr. Paul announced that the ROTC military ball will be held at Brookside Manor on March 14.
Ms. Tobiassen asked if there are any plans to have an Odyssey of the Mind Team next year. Dr. Eastwood answered “yes”. Ms. Tobaissen requested a presentation be given on our gifted and talented program for the district.
