BOARD OF EDUCATION

MIDDLETOWN, NEW YORK

DECEMBER 21, 2006

 

A regular meeting of the Board of Education of the Enlarged City School District of Middletown, New York was held Wednesday, December 21, 2006, at the Board of Education Office, 223 Wisner Avenue, Board President Vincent Crescenzo, presiding.

Present: Mr. Estrada (left at 6:50 – attended Executive Session only), Mrs. Knapp, Mr. Paul, Ms. Perkins, Mr. Perrino, Ms. Tobiassen, Mr. Crescenzo – 7.

Absent: Mrs. Botti, Mr. Geiger - 2.

Mr. Crescenzo called the meeting to order at 6:05 p.m. Ms. Tobiassen made a motion, seconded by Mr. Estrada, to have an executive session to discuss leading to the appointment or employment of specific personnel. Motion was unanimously approved.

Public session resumed at 6:55 p.m.

Mr. Crescenzo led the pledge to the flag.

Mr. Estrada made a motion, seconded by Ms. Perkins, to approve Personnel Memorandum #39.

Ayes: Mrs. Knapp, Mr. Paul, Ms. Perkins, Mr. Perrino, Ms. Tobiassen, Mr. Crescenzo – 6. Noes: None. Motion was unanimously approved.

Ms. Tobiassen made a motion, seconded by Mr. Perrino, to amend the agenda to accept Resolution No. 1 and Resolution No. 2 regarding recent litigation.

Ayes: Mrs. Knapp, Mr. Paul, Ms. Perkins, Mr. Perrino, Ms. Tobiassen, Mr. Crescenzo – 6. Noes: None. Motion was unanimously approved.

Mr. Perrino made a motion, seconded by Ms. Tobiassen, to approve Resolution No. 1 – Settlement Agreement, as follows:

RESOLUTION NO. 1:
MIDDLETOWN ENLARGED CITY SCHOOL DISTRICT

Upon recommendation of the Superintendent of Schools and District Legal Counsel, it is hereby,

RESOLVED, that a Settlement Agreement and General Release, fully and finally settling a certain Federal employment litigation is hereby approved, and that the President of the Board of Education is authorized to execute same on behalf of the Board.

Ayes: Mrs. Knapp, Mr. Paul, Ms. Perkins, Mr. Perrino, Ms. Tobiassen, Mr. Crescenzo – 6. Noes: None. Motion was unanimously approved.

Mr. Perrino made a motion, seconded by Ms. Perkins, to approve Resolution No. 2 – Letter of Agreement, as follows:

RESOLUTION NO. 2:
MIDDLETOWN ENLARGED CITY SCHOOL DISTRICT

Upon recommendation of the Superintendent of Schools and District Legal Counsel, it is hereby,

RESOLVED, that a certain Letter Agreement dated December 19, 2006 between the District and the District’s insurance carrier, United National Group, is hereby approved and the President of the Board of Education is authorized to execute same on behalf of the Board.

Ayes: Mrs. Knapp, Mr. Paul, Ms. Perkins, Mr. Perrino, Ms. Tobiassen, Mr. Crescenzo – 6. Noes: None. Motion was unanimously approved.

There being no further business, at 7:40 p.m., Mr. Perrino made a motion, seconded by Ms. Perkins, to adjourn the meeting at this time. Motion was unanimously approved.

RESOLVED: That the reading of the teaching and administrative personnel list be waived and the retirements, expirations of terms, abolition of positions, preferred eligible list of candidates for appointment, appointments, transfers, leaves of absence and reinstatements from leaves of absence in the INSTRUCTIONAL SECTION OF THE PERSONNEL MEMORANDUM dated December 21, 2006 be approved as recommended by the Superintendent of Schools.
