SPECIAL MEETING

AUGUST 26, 2005


A special meeting of the Board of Education of the Enlarged City School District of Middletown, New York was held Friday, August 26, 2005, at the Board of Education Office, 223 Wisner Avenue, Board President Vincent Crescenzo, presiding.

Present: Mr. Geiger, Mrs. Knapp, Ms. Perkins, Mr. Perrino, Mrs. Botti, Mr. Crescenzo – 6.

Absent: Dr. Best, Mr. Estrada, Ms. Tobiassen – 3.

Others: Kenneth W. Eastwood, Superintendent of Schools

Mr. Crescenzo called the meeting to order at 5:35 p.m. He said that this special meeting was called to discuss specific personnel issues.

Mr. Geiger made a motion, seconded by Mr. Perrino, to have an executive session for the discussion of matters leading to the discipline, suspension, dismissal or removal of a particular person.

Ayes: Geiger, Knapp, Perkins, Perrino, Botti, Crescenzo – 6. Noes: None. Motion was unanimously approved.

Public session resumed at 6:30 p.m.

Mrs. Botti made a motion, seconded by Mr. Geiger, to approve the following resolution:

WHEREAS, the Board of Education is in receipt of a determination, dated August 22, 2005 of Howard C. Edelman (the “Arbitrator”) concerning the Section 3020-a charges preferred against tenured school district employee Bernard Cohen; and

WHEREAS, the Arbitrator found Bernard Cohen guilty of Charges I, II, III and IV and determined that the penalty shall be termination of his employment;

THEREFORE, BE IT RESOLVED that the employment of Bernard Cohen shall be terminated effective immediately.

Ayes: Geiger, Knapp, Perkins, Perrino, Botti, Crescenzo – 6. Noes: None. Motion was unanimously approved.

At 6:35 p.m., Mr. Geiger made a motion, seconded by Mr. Perrino, to adjourn this meeting. Motion was unanimously approved.
